Drug-facilitated sexual assault occurs when a person gives alcohol or drugs to someone in order to take advantage of them sexually. That is actually, not sex at all. In the state of Nevada, that is rape because consent is not freely given. The thing about drug-assisted rapes is that many times the drugs and alcohol are taken willingly because someone thinks they are partying with friends and they feel safe. But in the end, the drugs are used to harm them. The person may not be thinking clearly or have the same amount of body strength to protect themselves and they may feel scared to report what happened to them because they believe it was their own fault or afraid they will get in trouble because of the drug or alcohol use. If you are under the age of 21 and drinking or using drugs during the time of an assault, you will not be charged when reporting the crime to the police. The serious crime of sexual assault will be the focus for authorities. You deserve to have a hangover after a night of drinking, you NEVER deserve the crime of sexually assault. You may have heard about roofies (Rohypnol), GHB (its nickname is Grievous Bodily Harm-You do not want that in your body, do you?), and Ketamine (a large animal tranquilizer yeah, you read that right. If they use this drug for large animals in surgery, imagine the damage it can create in a human body.) Meth, marijuana, prescription drugs, ecstasy; they can all be used to assist in sexual assault. So remember this: If your friend is way more drunk than what you would expect from how much they have had to drink, something may be happening that you need to take notice. Just because someone chooses to use drugs or be in a party atmosphere, does not mean they deserve to be raped. No one does. They may deserve to be arrested because they broke the law or to feel sick because drugs harm our bodies, but they do not deserve to be in sexual danger. Remember though, when someone cannot say YES to sex (because they are using drugs or alcohol, under age, have disabilities that do not allow them to say YES on their own, are asleep or belong to the same family), that is not sex-it is rape.
